Terms and Conditions

Just Jump USA® – Consumer Terms & Conditions

(JustJumpUSA.com, LLC d/b/a Just Jump USA®)

Effective Date: 08/01/2025


1. Acceptance of Terms

By accessing or using the Just Jump USA® platform, website, or related services (the “Platform”), you (“Consumer,” “User,” or “You”) agree to these Terms & Conditions. If you do not agree, do not use the Platform.

2. Nature of Services

  • Just Jump USA® operates as a lead generation and marketing platform.
  • We connect consumers with independent providers (“Providers”) who may be able to perform roadside assistance or related services.
  • Just Jump USA® does not perform services directly, set pricing, or guarantee outcomes. Providers operate as independent businesses with their own terms, conditions, and liability.

3. No Agency or Employment

Use of the Platform does not create any employment, agency, or joint venture relationship between you and Just Jump USA®. Providers are not our employees or subcontractors.

4. Pricing and Payments

  • You may receive quotes from up to three (3) Providers per request.
  • You are free to choose which Provider, if any, you engage.
  • Just Jump USA® is not a party to any transaction between you and a Provider. Payment terms are strictly between you and the Provider.

5. Consumer Responsibilities

  • You must provide accurate, truthful, and complete information when submitting a request.
  • You agree to answer phone calls and communications from Providers after submitting a request.
  • You are responsible for selecting a Provider that meets your needs.

6. Service Disclaimer

  • Services are provided “as-is” and “as-available.”
  • Just Jump USA® makes no warranties, expressed or implied, regarding the quality, timeliness, or safety of services delivered by Providers.
  • We are not liable for damages, injuries, or losses resulting from Provider services.

7. Data & Privacy

  • Information you submit (name, phone number, service request, etc.) will be shared with up to three Providers.
  • Providers may only use your data for purposes of fulfilling your request.
  • For details, see our Privacy Policy.

8. Disputes with Providers

  • Any disputes over pricing, quality of work, or damages are between you and the Provider.
  • Just Jump USA® may, at its discretion, provide limited assistance but has no obligation to resolve disputes.

9. Limitation of Liability

  • To the maximum extent permitted by law, we shall not be liable for:
    • Losses, damages, or claims related to Provider services.
    • Indirect, incidental, or consequential damages.
  • Our total liability, if any, shall not exceed $100.

10. Indemnification

You agree to indemnify and hold harmless JustJumpUSA.com, LLC, its officers, employees, and affiliates from claims, damages, or costs arising from:

  • Your misuse of the Platform.
  • Your disputes with Providers.
  • Your violation of these Terms.

11. Billing Disputes (If Applicable)

  • If any fees are charged directly by Just Jump USA® (e.g., for optional upgrades), you must notify us of disputes within 30 days of billing.
  • Refunds, if issued, are solely at our discretion.

12. Governing Law & Arbitration

  • These Terms are governed by the laws of the State of Florida.
  • Any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA).
  • Arbitration shall take place in Leon County, Florida.
  • Consumers waive any right to participate in class actions.

13. Modifications

We may update these Terms from time to time. Updated Terms will be posted on our website with a revised effective date. Continued use of the Platform constitutes acceptance.

Consumer Data & Privacy Section

1. 

Data Ownership

  • Any information you submit (name, phone number, email, service details, photos, etc.) remains your property.
  • Avant-Garde Group, LLC (d/b/a Just Jump USA®) does not claim ownership of your personal data.

2. 

Use of Data

  • Your data is used solely to connect you with providers in our network who may be able to fulfill your service request.
  • We may use anonymized or aggregated data to analyze trends, improve our services, or develop new offerings.

3. 

Data Sharing

  • Your request details (name, phone number, service type, location, and any notes you include) are shared with up to three (3) providers in our network at a time.
  • Those providers may use your information only to contact you regarding the request you submitted. They may not resell, reuse, or otherwise exploit your information for unrelated purposes.
  • We may disclose data if legally required, such as by subpoena, court order, or government request.

4. 

Data Security

  • JustJumpUSA.com, LLC employs reasonable safeguards (secure servers, encryption, restricted access) to protect your data.
  • However, no online system is 100% secure. By using our platform, you acknowledge and accept the inherent risks of online data transmission.

5. 

Data Retention

  • We retain your submitted service request and related communications for purposes of audit, dispute resolution, fraud prevention, and compliance.
  • If you request deletion of your data, we will honor it except where retention is legally required.

6. 

Marketing Communications

  • By submitting a request, you agree to receive transactional notifications (e.g., provider contact, confirmation messages, updates).
  • You may also opt in to receive promotional communications about our services. You may unsubscribe at any time.

7. 

No Liability for Providers’ Practices

  • While we require providers to comply with strict rules regarding the use of your data, we are not responsible for how providers independently handle your information once you communicate with them.
  • We encourage you to review their terms and ask questions directly when engaging their services.

 

Just Jump USA® Provider Terms & Conditions

These Terms & Conditions (the “Agreement”) govern the relationship between JustJumpUSA.com, LLC (d/b/a “Just Jump USA®”) (“Company,” “we,” “our,” or “us”) and any individual or entity (“Provider,” “you,” or “your”) that applies for, subscribes to, or participates in the Just Jump USA® provider membership network (the “Network”).

By enrolling in the Network, you agree to be bound by this Agreement, including its dispute resolution and arbitration provisions. If you do not agree, do not enroll or participate in the Network.


1. Membership & Eligibility

1.1 Eligibility. Providers must:

  • Be at least 18 years old (or the age of majority in their jurisdiction).
  • Hold all licenses, permits, and insurance required to operate legally in their service area (where applicable).
  • Successfully complete any background check(s) required by Just Jump USA® or its third-party vendors.

1.2 Membership Plans. Access to the Network is available through annual membership plans. Membership is personal to you and non-transferable.

1.3 No Employment Relationship. You are an independent business and not an employee, agent, partner, or franchisee of Just Jump USA®.

1.4 Service Area Limitations

  • Providers may designate a service area comprising up to 15 ZIP codes within a contiguous geographic radius of their primary business location.
  • If a Provider wishes to operate in distinct, non-contiguous markets (e.g., across multiple cities or states), each requires a separate membership or premium and note of physical presence.
  • Just Jump USA® reserves the right to request documentation verifying operational capacity in designated service areas and to suspend or revoke access if verification is not provided.

1.5 Profile Accuracy

Providers are responsible for maintaining accurate and up-to-date information in their profiles, including business name, contact details, ZIP codes, services offered, and availability. Misrepresentation of services or credentials is grounds for suspension or termination.

1.6 Legal Compliance

Providers must comply with all applicable local, state, and federal laws, including but not limited to licensing, permits, insurance, and tax obligations. Just Jump USA® is not liable for a provider’s failure to meet these requirements.

1.7 Confidentiality & Non-Misuse of Platform

Providers agree not to misuse Just Jump USA® systems, leads, or customer data for unauthorized purposes, including but not limited to reselling leads, scraping customer information, or soliciting outside of the agreed marketplace terms. Any misuse will result in termination without refund.

1.8 Technology & Platform Use

Providers must access the marketplace through approved portals, platforms, or systems. Use of bots, automation, or manipulation of the platform (e.g., artificially inflating availability or generating false profiles) is strictly prohibited. Violations may result in immediate suspension or termination.

1.9 Payment Responsibility

Providers are solely responsible for all costs related to fulfilling services, including tools, fuel, insurance, licensing, and taxes. Just Jump USA® is not responsible for reimbursement of any expenses incurred in connection with services performed.

1.10 Suspension & Termination for Conduct

In addition to violations of accuracy or compliance, Just Jump USA® may suspend or terminate a provider’s membership if the provider engages in egregious, unsafe, fraudulent, or unethical conduct. Examples include harassment, repeated no-shows, unsafe service practices, or falsified insurance/licensing. No refunds will be issued in these cases.

1.11 Public Representation & Branding

Providers may identify themselves as “Jump Pros” affiliated with Just Jump USA®, but may not misrepresent themselves as employees, subcontractors, or agents of the company. All customer interactions are owned by the provider, and misuse of the brand is grounds for termination.


2. Services & Leads

2.1 Leads Provided. Membership grants you access to consumer leads generated through Just Jump USA®’s marketing channels. Leads are distributed on a non-exclusive basis unless otherwise stated.

2.2 Consumer Relationship. All services provided to consumers are performed under your sole control, responsibility, and terms. Consumers are not customers of Just Jump USA®, and we do not guarantee their payment, behavior, or outcomes.

2.3 No Service Guarantee. We make no guarantee of any minimum lead volume, service frequency, or profitability.

3. Fees, Billing & Payment

3.1 Membership Fees. Providers agree to pay the published annual membership fee (e.g., $97 per year for standard membership, unless otherwise stated).

3.2 Renewals. Membership automatically renews annually unless canceled at least 30 days before the renewal date.

3.3 No Refunds. All membership fees are non-refundable, except as required by law.

3.4 Payment Processing. Payments are handled by third-party processors (e.g., Stripe, Outseta). By subscribing, you authorize us and our processors to store your payment method and process recurring charges.

3.5 Disputed Payments. If you dispute a charge, you must notify us in writing within 15 days. Filing a chargeback without first contacting us constitutes a breach of this Agreement.

4. Provider Obligations

4.1 Compliance. You agree to comply with all applicable laws, regulations, licensing, and insurance requirements.

4.2 Accuracy of Information. You must provide accurate, current, and complete information during enrollment and maintain it thereafter.

4.3 Conduct. You will:

  • Treat consumers respectfully.
  • Refrain from fraudulent, deceptive, or illegal practices.
  • Not misrepresent yourself as being employed or contracted by Just Jump USA®.

5. Intellectual Property

5.1 License. Providers may use the Just Jump USA® name and marks only as permitted in writing and only to identify themselves as part of the Network.

5.2 Restrictions. You may not use our trademarks or intellectual property in a way that suggests you are an employee, franchisee, or exclusive agent of Just Jump USA®.

6. Limitation of Liability

6.1 Disclaimer. JUST JUMP USA® PROVIDES THE NETWORK “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING FITNESS FOR A PARTICULAR PURPOSE.

6.2 Limitation. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUST JUMP USA® SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES. OUR TOTAL LIABILITY TO ANY PROVIDER SHALL NOT EXCEED THE AMOUNT PAID BY THAT PROVIDER TO JUST JUMP USA® IN THE PAST 12 MONTHS.

7. Termination

7.1 By Provider. You may cancel your membership at any time. However, no refunds will be issued.

7.2 By Company. We may suspend or terminate your membership immediately if:

  • You fail to pay fees.
  • You violate this Agreement.
  • You engage in conduct damaging to Just Jump USA®’s reputation.

8. Dispute Resolution

8.1 Mandatory Arbitration. Any dispute arising under this Agreement shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

8.2 Waiver of Class Actions. You waive the right to participate in any class, collective, or representative action.

8.3 Venue. Arbitration shall take place in Leon County, Florida, unless otherwise agreed.

9. Indemnification

You agree to indemnify, defend, and hold harmless Just Jump USA®, its officers, employees, and affiliates from any claims, damages, or liabilities arising from your services, actions, or omissions.

10. General Provisions

10.1 Entire Agreement. This Agreement constitutes the entire agreement between you and Just Jump USA®.

10.2 Amendments. We may update these Terms at any time by posting the revised version on our website. Continued participation constitutes acceptance.

10.3 Governing Law. This Agreement shall be governed by the laws of the State of Florida, without regard to its conflict of laws rules.

Data & Privacy Section for Terms & Conditions

1. 

Data Ownership

  • Customer Data: Any information a customer submits (name, phone number, email, service request, etc.) remains the property of the customer.
  • Provider Data: Any information you (the provider) submit (application info, background check details, insurance docs, payment data, etc.) remains your property.
  • Company Data: Aggregated or anonymized data generated by the platform (analytics, trends, conversion rates, etc.) belongs to JustJumpUSA.com, LLC.

2. 

Use of Data

  • We use customer-submitted information solely to match service requests with providers.
  • Provider information is used for membership eligibility, lead distribution, and compliance.
  • We may use aggregated data for internal analytics, improving services, and marketing insights, but never in a way that identifies you personally without consent.

3. 

Data Sharing

  • Customer contact info (phone number/email) is only shared with up to [3] providers per lead request, per the business model, unless otherwise stated.
  • Providers understand and consent that customer data received via leads is for fulfilling that service request only and cannot be sold, resold, or reused for unrelated marketing.
  • We may disclose data if required by law, subpoena, or regulatory request.

4. 

Data Security

  • We use reasonable security measures (encryption, secure storage, restricted access) to protect data.
  • However, no system is 100% secure — by using the platform, providers acknowledge that they assume the inherent risk of online data transmission.

5. 

Data Retention

  • Customer leads and related communications may be stored for audit, compliance, and dispute resolution.
  • Provider data (background checks, account details) may be retained for as long as your membership is active plus a limited period afterward as required by law.

6. 

Marketing Communications

  • By enrolling, providers consent to receive operational, promotional, and compliance-related emails/texts from us.
  • Providers and customers may opt out of marketing messages, but not critical service communications (e.g., billing notices, lead delivery alerts).

7. 

Background Check Data

  • Providers acknowledge that background check results are processed and stored by our third-party vendor (e.g., Checkr).
  • We do not retain raw sensitive data (like SSNs) outside the secure vendor system.
